1. My Digital Health Terms of Use

 

Please note: We have now retired the My Digital Health platform, so much of the below is no longer applicable / relevant.

Welcome to the My Digital Health Platform website (Parent Website) which is published by Federation University Australia, Ballarat, Australia, for the purpose of providing up to date information, digital health programs (e.g., Life Flex), digital health infrastructure (e.g., secure emailing, instant messaging and telehealth video-chat facilities, shared collaborative digital work-spaces, digital client files), and other resources on health and wellbeing for the benefit of the public (consumers, health practitioners and researchers). The My Digital Health Platform is the parent website that contains numerous digital health program sites (Child Sites) with information content and resources (Information) and infrastructure and related features such as the communications system (Infrastructure Features).

These Terms of Use apply to the use of the Parent and Child Websites, the platform’s infrastructure and features, the content of the Parent and Child Websites, and any material accessed through the Parent and Child Websites. Some of the Child Websites and use of the platform’s Infrastructure Features, where offered, will also involve you providing additional informed consent to access it.

In these Terms of Use, “Federation University” refers to Federation University Australia ABN 51 818 692 256 as the licensed owner of the Parent & Child Websites and Infrastructure Features, and the terms “you” and “your” refer to the user or viewer of the Parent and Child Websites, the information contained in, or accessed through, the Parent and Child Websites and the My Digital Health Infrastructure Features.

 

1.1 Acceptance of Terms of Use

 

By accessing or using this Parent and Child Websites and Infrastructure Features, you are deemed to have read and accept these Terms of Use which together with our Privacy Statement  govern Federation University Australia’s relationship with you in relation to the Parent & Child Websites and Infrastructure Features. Federation University may change the content of the Parent and Child Websites and Infrastructure Features and these Terms of Use at our discretion and without notice. By continuing to use the Parent and Child Websites and Infrastructure Features, you accept the Terms of Use as they apply from time to time. It is your responsibility to check the Terms and Conditions regularly for any changes. No representation or warranty (express or implied), except as required by law, is made as to the currency, completeness, accuracy, reliability, suitability and / or availability of the Information.

My Digital Health at Federation University Australia reserves the right to, and may at any time and without notice and any liability to you, modify or discontinue this Parent and Child Websites, Information and Infrastructure Features or delete the data you provide, whether temporarily or permanently. My Digital Health at Federation University Australia has no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data, information or services.

 

1.4 Disclaimer of liability

 

You acknowledge that your use of any Information or materials on the Parent and Child Websites and/or Infrastructure Features is entirely at your own risk and that the Information and the Infrastructure Features may contain inaccuracies or errors.

1.5 Copyright and trademarks

 

All content on the Parent and Child Website and Infrastructure Features, including (without limitation) text, graphics, all software, information architecture and coding (including any copyright subsisting in them), is owned by Federation University or licensed to us. All content is protected by copyright, trademarks, patents and other intellectual property rights and laws.

You may access and download the material on the Parent and Child Websites only however you may not, subject to a use for the purposes of private study, research, criticism or review as permitted under the Copyright Act 1968 (Cth), modify, reverse engineer, publish, transmit, distribute, participate in the transfer or sale, create derivative works from, or in any way commercialise or exploit, any of the Parent and Child Websites content and Infrastructure Features in whole or in part without the prior written permission of the owners.

None of the content or programming code may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder, apart from the uses noted above.
